Welcome, and thanks for visiting kellergaragedoorrepair.com. These Terms of Service (“Terms”) cover your use of this website and any service request you submit through it. By browsing the site, submitting a request, or calling us, you’re agreeing to be bound by these Terms. If you don’t agree, please don’t use the site.
Important notice: These Terms include a binding arbitration agreement and a class-action waiver - both are explained in Section 2. Those provisions affect how disputes between you and Otto’s Garage Door are resolved, so please read that section carefully.
We may update these Terms from time to time. The “Last Updated” date at the top of this page will reflect any changes, and continued use of the site after an update means you accept the revised Terms.
2. Dispute Resolution
Talk to us first. If something goes wrong, we’d like the chance to work it out before anything formal begins. Please reach out through https://kellergaragedoorrepair.com/contact-us/ and give us a reasonable opportunity to resolve your concern informally. Most issues can be sorted out this way.
Binding arbitration. If we can’t resolve a dispute informally, you and Otto’s Garage Door agree that the dispute will be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. Both of us give up the right to litigate that dispute before a judge or jury in a court of law, except as noted below.
Class action waiver. Claims must be brought on an individual basis only. Neither you nor Otto’s Garage Door may bring or join a class action, collective action, or consolidated action, and neither side may participate in any class or representative arbitration. The arbitrator has no authority to consolidate more than one person’s claims or to preside over any form of class or representative proceeding. This class action waiver is a material part of this agreement.
Jury waiver. To the extent any matter proceeds in a court (as permitted below), both you and Otto’s Garage Door waive any right to a trial by jury.
Small claims carve-out and injunctive relief. Either side may bring an individual claim in small claims court if it qualifies. Either side may also seek emergency injunctive or other equitable relief from a court to prevent misuse of the website or infringement of intellectual property rights, without first going through arbitration.
30-day opt-out. You have the right to opt out of this arbitration agreement. To do so, send us written notice within 30 days of the date you first accept these Terms through https://kellergaragedoorrepair.com/contact-us/. Opting out of arbitration has no effect on any other provision of these Terms.
3. Governing Law
These Terms are governed by and construed under the laws of the State of TX, without giving effect to any conflict-of-law rules or provisions that would require the application of another state’s law. To the extent a court proceeding is permitted under the arbitration section above, you and Otto’s Garage Door agree that it must be brought exclusively in the state or federal courts located in TX, and you consent to personal jurisdiction in those courts.
4. Independent Businesses and Their Work
Every home-service job arranged through kellergaragedoorrepair.com is performed by an independent contractor business - not by Otto’s Garage Door. Those businesses are not our employees, agents, representatives, joint venturers, or legal partners in any sense. We do not control how they operate, how they staff their crews, how they price their work, or how they carry out a job.
Because of that, Otto’s Garage Door is not responsible or liable for any of the following:
- The quality, safety, timeliness, or outcome of any work they perform
- Their pricing, billing practices, or estimates
- Whether they hold the licenses or insurance required in your area
- Their employees, subcontractors, or anyone else they send to your property
- Any act, omission, negligence, injury, property damage, or loss caused by them
When a business shows up to do the job, the agreement for that work is formed directly between you and that business. Otto’s Garage Door is not a party to that contract and has no obligations under it.
Passing your request along to a business is not an endorsement, certification, or guarantee of their work or credentials. Before authorizing any job, we encourage you to confirm that the business is properly licensed and insured in TX and to review and sign a written contract. If you have a dispute about the work, materials, or billing, that’s a matter between you and the business that performed it.
5. Your Indemnification Obligations
You agree to indemnify, defend, and hold harmless Otto’s Garage Door, its owners, officers, employees, and affiliates, as well as the independent businesses in our referral network, from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and reasonable attorneys’ fees arising out of or related to:
- Your use of kellergaragedoorrepair.com or any content you access through it
- Any information you submit, including its accuracy and your authority to provide the phone number you gave us
- Your breach of these Terms or any applicable law or regulation
- Your interactions, transactions, or disputes with any business you are referred to through our site
This obligation to indemnify and defend us survives the end of your use of the site or any termination of these Terms.
6. Appointments, Cancellations, and Rescheduling
Once your request is passed along, scheduling is handled directly between you and the business that accepts the job. That business sets its own availability, notice requirements for cancellations, and any fees it charges for late cancellations or no-shows - those are its policies, not ours.
We ask that you give reasonable advance notice if you need to cancel or reschedule. We’re happy to pass a cancellation message along to the business on your behalf, but we don’t control that business’s calendar and can’t guarantee the change will be accommodated in any particular way.
7. Workmanship Warranty
Because Otto’s Garage Door does not perform any home-service work, we give no warranty or guarantee - express or implied - on workmanship, parts, or materials of any kind. Any warranty on the job itself comes from the independent business that performed it, under whatever terms that business offers. Any parts or materials warranty comes from the manufacturer on the manufacturer’s own terms. Before work begins, ask the business to give you its warranty terms in writing.
If you’re not satisfied with the work that was done, here is what Otto’s Garage Door will do: we’ll act as a go-between and reach out to the company that performed the job to arrange a follow-up visit on your behalf. That is a courtesy coordination effort - it is not a guarantee of any particular result or resolution. Otto’s Garage Door will never perform, redo, or repair the work itself. We also cannot promise a refund of any money you paid to the performing business; any financial dispute is between you and that business.
8. Limitation of Otto’s Garage Door’s Liability
The website and referral service are provided “as is” and “as available.” We make no promise that a business will be available for your request, will contact you within any particular timeframe, or will produce any specific result.
To the fullest extent permitted by applicable law, Otto’s Garage Door will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or damage to property, arising out of or related to your use of kellergaragedoorrepair.com or the referral service - even if we have been advised of the possibility of such damages.
Our total liability to you for any claim relating to this website or the referral service is capped at one hundred dollars ($100.00), or the amount you actually paid Otto’s Garage Door directly - which is ordinarily nothing - whichever is greater.
This cap applies only to Otto’s Garage Door’s own conduct in operating the website and referral platform. It does not limit, reduce, or affect the liability of the independent business that performed the work. Responsibility for the work itself - including any damage, injury, or loss connected to it - rests with the business that performed it.
9. How Otto’s Garage Door Works
Otto’s Garage Door operates kellergaragedoorrepair.com as a referral platform and marketing brand for home services in Keller, TX and the surrounding area. We advertise home services, take service requests through this website and by phone, and pass those requests to independent businesses who are equipped to handle them.
Every estimate, repair, installation, and service call is performed by our network of affiliated service providers and the licensed tradespeople who carry out the work - not by Otto’s Garage Door. We do not perform home-service work ourselves, we do not employ the tradespeople who do it, and we do not direct or supervise how any job is carried out.
Scheduling, pricing, materials selection, and the scope of any given job are determined entirely by the business that takes your request. Availability is not guaranteed - we will do our best to connect you with a business that can help, but we cannot promise that a match will always be available for your location or timeframe.
10. Acceptable Use
When you use kellergaragedoorrepair.com, you agree to use it only for its intended purpose - submitting legitimate home-service requests. You agree not to:
- Scrape, crawl, or use any automated tool to harvest content or data from the site
- Submit false, misleading, or fraudulent service requests
- Provide someone else’s phone number without their knowledge and permission
- Attempt to interfere with, damage, or misuse the site or its underlying systems
- Use the site for any unlawful purpose or in violation of any applicable law
11. Eligibility
To use this website and submit a service request, you must be at least 18 years old and legally capable of entering into a binding contract under applicable law. By submitting a request, you also confirm that you have the legal authority over the property where the work is to be performed - whether as an owner or as someone with the owner’s permission to authorize the job.
